How come if certain types of people get attacked, it's only a regular crime, while if other types of people get attacked, it's a special "HATE" crime?

Aren't we all entitled to equal protection? Especially from physical attacks? My body being attacked merits less punishment than another person's?
What if someone hates middle aged fat guys and attacks me solely for that reason?
We need special legislation to make it a different type of crime than plain old other violent attacks?
Aren't I just as good as another type of of person who happens to get laws with extra sauce making it a hate crime to attack him or her?

What if we find out a prison guard hates brothers...if he gives a lethal injection as part of his job, does it become a hate crime?
